The below rental terms and conditions apply to all reservations. Please read these terms carefully. By accessing and/or using the site, you fully and unconditionally accept and agree to be bound by these terms. For bookings that are made with Advance through our websites, please refer to their advertised terms and conditions of the rental voucher.

DEFINITIONS. "Agreement" means all terms and conditions found on both sides of this form, any addenda, or any additional materials we provide at the time of rental. "You" or "your" means the person identified as the renter on Page 1, any person signing this agreement, any authorized driver, and any person or organization to whom charges are billed by us on the renter's direction. All persons referred to as "you" or "your" are jointly and severally bound by this agreement. "We," "our" or "us" means the Rental Agent identified on Page 1. "Authorized Driver" means you, any additional driver approved by us and listed by us on this agreement, and any other driver authorized by the law of the state where the vehicle is rented if a person has a valid driver's license and, unless the law of this state requires otherwise, is at least twenty-one (21) years of age. "Vehicle" means the automobile identified in this agreement and any substitute and all its tires, tools, accessories, keys, equipment, keys, and vehicle documents. "Physical damage" means all damage to, or loss of, the Vehicle caused by collision or upset; it does not include damage to, or loss of the Vehicle due to theft, vandalism, act of nature, riot or civil disturbance, hail, flood, or fire. "Loss of use" means the amount calculated by multiplying the number of days/weeks/months from the date of damages to the Vehicle until it is repaired times the corresponding periodic rental rate unless otherwise provided by law.

DRIVER REQUIREMENTS. The minimum age to rent a vehicle is 21 years old. The renter and all authorized drivers must present a valid, unexpired, and original driver's license at the time of the rental. The driver's license must be in good condition and valid for the entire rental period. Temporary Licenses are only accepted when presented alongside the original expired or voided driver's license. Photocopies, digital licenses, learner's permits, and driver's licenses with driving restrictions will NOT be accepted. All drivers with a non-US driver's license must produce a valid passport at the time of rental. Renters and additional drivers under the age of 25 are subject to a surcharge fee and can ONLY rent economy to full-size cars. For certain specialty and large-sized vehicles, the minimum age of 25 years of age applies.

DRIVER'S LICENSE. The primary piece of identification required to rent a vehicle with Advance is a valid driver's license. For international customers or those using a non-US driver's license, you must provide a secondary form of ID as a valid passport.

Points- endorsements: Minor offenses such as speeding/traffic signals are acceptable up to a maximum of 6 points. If you have any bans or convictions in the last 5 years, please call us before making a reservation.

RENTAL COVERAGES. Optional coverage is not required to rent a vehicle; however, proof of a current automobile comprehensive, collision, and liability insurance policy in the renter's name covering injury to third-party persons or property is REQUIRED. Optional coverage is available at the rental counter.

METHODS OF PAYMENT. We accept many methods of payment such as credit and debit cards like Visa, Mastercard, Discover, and American Express. Please note the primary renter must be the cardholder and has to present a valid card at the counter. Advance does not accept cash, checks, prepaid cards, or gift cards as methods of payment. Please Note: Payments with a credit card may require the credit card PIN.

We accept debit cards when the following requirements are met:

- Customer presents a Driver's License from a state different than the pick-up state, or

- Customer presents a flight, train, or bus roundtrip itinerary matching the pick-up and return dates of Advance rental and made at least 24 hours before pick-up, and

The vehicle category is an Economy through Full-size sedan, a Compact through Intermediate SUV, a Pick-up truck, or a Van.

DEPOSITS. A standard $250 deposit is required on a major credit card for any domestic renter.

Local renters (or clients with no return flight) using a credit card are subject to up to a $500 deposit.

International renters and inclusive rentals will have a deposit of up to $1,800.

The renter must present a valid debit card or credit card and the expiration date must be after the rental due date. The cardholder must be registered as the primary driver on the rental agreement. Debit or credit cards are non-transferable. The deposit is refundable or released after the end of the rental agreement. (See debit card use section below)

*Subject to insurance for rental.

DEBIT CARD USE. Domestic and international renters: Using a debit card to pay a deposit, a domestic or international renter must verify the return confirmation airline ticket and an additional ID presented at the rental counter at the time of pick-up.

LOCAL RENTALS: All local renters are subject to verification of proof of a current automobile comprehensive, collision, and liability insurance policy in the renter's name covering injury to third persons or property required from a primary insurance company. A current utility statement in the renter's name and the same address as on the driver's license, for example, gas, electric, cable, etc. must be presented for address verification.

LOCAL RENTERS' REQUIREMENTS. All local renters or any renter without a return confirmation airline ticket who wishes to rent a car will be required to show proof of a current automobile comprehensive, collision, and liability insurance policy in the renter's name covering injury to third persons or property. In addition, local renters may be asked for a current cell phone bill matching their respective driver's license.

Renters traveling on official government business, on military leave, or with an approved CID number are exempt from the local renter policy. Failure to show an acceptable policy will result in the rental being declined.

Local renter vehicle exclusions: Local renters are limited to renting the following car class sizes compact (BA), Intermediate (CA), full size (DA), Intermediates SUV (DAE), minivan (MZA), and van (MX).

MILEAGE CAP. Local renters are subject to a mileage cap of 150 miles per day.

Please be advised overage miles for the rental period will be charged at $1.49 per mile.

GEOGRAPHIC LIMITATIONS. ALL cars are restricted to the State of Florida. Vehicles that leave the state of Florida will be charged a penalty, the towing fee to return the car to our branch, plus the total cost of the rental. 

WEBSITE VEHICLE DISPLAY. The featured vehicles that are displayed for each car class on the Advance website or partner booking sites are only representations of the type of vehicle that may be available at the time of pickup. We cannot guarantee that the make or model of the rental vehicle will be offered or available at the time of pick-up due to fleet variances in availability or other reasons. We will provide you with either this model or a similar vehicle in size and engine type that is the same as the vehicle displayed on our website.

CANCELLATIONS.

$100 for cancellations up to 24 hours before pick-up time, $200 for cancellations within 24 hours before pick-up time:

A prepaid booking can be canceled before the start of the rental. In the event of a cancellation, any refund of the payment made towards the rental is subject to a cancellation fee. The cancellation fee will never exceed the total prepaid amount.

- Cancellations up to 24 hours before scheduled pickup time will result in the collection of a $100 cancellation fee (excl. tax). The remaining prepaid amount over $100 (excl. tax) will be refunded.

- Cancellations within 24 hours before the scheduled pickup time will result in the collection of a $200 cancellation fee (excl. tax). The remaining prepaid amount over $200 (excl. tax) will be refunded.

- No refund will be issued in case of cancellation after the scheduled pick-up time. If your reservation was confirmed through another provider (booking site, outside source, etc.) please use the same source to cancel the reservation. Some providers may charge for the cancellation of a reservation if not canceled within a specific time frame. Cancellation of a reservation directly through Advance when confirmed through another provider may not relieve your responsibility with that provider. To avoid charges (cancellation fee or penalty) check with the provider and cancel the reservation directly with them.

PAY NOW RESERVATIONS. All Advance Pay Now reservations are non-refundable. If you cancel your Advance Pay Now reservation, you will forfeit the full amount of your reservation payment. At the time of pick-up, you must present the same credit card/debit card that was used to pay for your Advance Pay Now reservation. If the card you used to book your Advance Pay Now Reservation is lost, stolen, or replaced by the card issuer and cannot be presented at the time of rental, you will have to process your reservation at the rental counter, and Advance will waive the cancellation fee at the time of pick-up.

OPTIONAL EXTRAS. Other extra services are NOT included in our rates. These services are available when booking or at the rental desk. (Additional Driver, Advance Express Toll Service, Satellite Navigation System (GPS), Child Seats, Roadside Service)

TOLL SERVICE. You are responsible for the payment of all tolls incurred during the rental period. We offer Advance-Express, an optional electronic toll payment service whereby all toll charges and any other toll-related fees you incur are covered during the rental period. Advance-Express must be accepted at the time of pickup and be applied for the entire length of the rental. Advance-Express Sunpass service is USD 14.99 per rental day & covers tolls incurred ONLY in Florida. Customers with Sunpass portable transponders may use their transponders in our rental vehicles at their own risk, as Sunpass does not acknowledge some devices, & in these cases, customers will be responsible for the charges incurred. (Sunpass peel-and-stick products will not function in Advance vehicles)

If you choose not to purchase the optional Advance-Express service at the commencement of your rental, and you utilize a toll road, you will be charged for each toll, plus a USD $40.00 admin fee per toll.

Advance-Express does NOT cover red light camera violations or other moving violations drivers incur. Advance-Express service does NOT cover airport parking.

ADDITIONAL DRIVER. An additional fee applies for the additional driver who needs to be present when collecting the vehicle to be added to the agreement as an authorized driver. All subsequent extra drivers must also adhere to our general policy and must be at least 21 years of age. In no event shall the vehicles be used, operated, or driven by any other person other than the renter or an authorized driver.

UNUSED RENTAL DAYS. Should the renter decide to return an Advance vehicle to our branch earlier than you originally planned, we shall NOT refund you for unused rental days.

LENGTH OF RENTAL. Rental agreements cannot be assigned for a period longer than 30 days. If you need to rent a vehicle for a longer period, you must go into the location before the 31st day and renew the rental agreement. The rate booked is guaranteed for the original duration of the reservation.

GRACE PERIOD. A rental day is each 24 hours commencing with the date/time indicated on the rental agreement at the time of rental. There is a 59-minute grace period for pick-ups and returns. Additional charges and rate recalculation may apply if your pick-up or return happens outside of the standard grace period.

EXTRENSIONS. To request an extension of the rental, you can use our Manage My Booking section on our website. The extra day rate may vary according to fleet availability and season. If the rental is overdue or/with a pending balance, extensions are not allowed on our website. If you are using third-party insurance or the website is not allowing your extension for any other reason, please communicate directly to the originated branch. Otherwise, the renter must return the vehicle to the branch immediately to avoid Late Return Fees or other related charges.

CURRENCY. The rates displayed on the Advance website are in US dollars. If the rates are impacted by a website technical issue, database issue, or other means will not be honored by the location if the rate displayed was inaccurate due to a technical issue or tampering issue with the change rate display.

TRAFFIC AND PARKING FINES. If the vehicle receives a fine during the rental period, you will be responsible for the full payment of the fine as well as a $40 admin fee. This includes, but is not restricted to, parking offenses, speeding fines, traffic signal offenses, toll road offenses, etc. The renter agrees to reimburse Advance Rent A Car LLC the fees of any collection agency, which may be based on a percentage at a maximum of 50% of the debt, and all costs, and expenses, including reasonable attorney's fees, Advance Rent A Car LLC incurs in such collection efforts.

FUEL POLICY. All cars must be returned with the same gas tank level that it was received at pick up on a "Same-to-Same basis". If the vehicle is returned with less fuel, the refueling charges will be payable at return or deducted from the deposit.  If the fuel was not purchased at the time of pick up there will be a $12.99 charge per gallon.

For your convenience, the fuel tank can be purchased at the start of the rental at the national pump prices.

If the rental is taken full, the car must be returned with a full tank of fuel from a garage no more than 5 miles away from the car rental branch.

- If you do not purchase the Hassle-free refueling / Prepaid Fuel in advance and return the Vehicle with less fuel than when rented, you will pay us for the fuel used at the price per gallon stated on your rental agreement.

- If you do not purchase the Hassle-free refueling / Prepaid Fuel in advance and return the tank full or at the same level when you received the vehicle, there will be no charges for fuel.  *No refunds for any unused fuel at the end of the rental. 

OTHER FEES. 

Late returns: The rate will increase by USD/25.00 per day each day the vehicle is kept beyond the standard grace period or the return date of rental. 

Early Pickup/Return: Additional charges may apply if your pick-up happens before the standard grace period. If you decide to return the rental prior to your return date/time Advance will NOT pro-rate or refund remaining days/hours. 

Smoking fee: We provide and implement a no-smoking policy for all vehicles in the fleet. If the vehicle is returned smelling of smoke from any source, you will be charged a smoke cleaning fee of up to $250 to remove the smoke odor.

Cleaning Fee: If the vehicle requires more than the usual standard cleaning on its return to restore it to its pre-rental condition, allowing for fair wear and tear, a cleaning fee of $250 will apply.

Pets: You are permitted to have pets in your hire vehicle provided they are in a carrier at all times. If the vehicle requires cleaning of pet hair or odor, then you will be billed for a cleaning fee at the branch's discretion.

CHARGES. You will pay us on demand for all charges due under this Agreement that are allowed by law, including, but not limited to: (1) time and usage for the period during which you keep the vehicle; (b) charges for optional services, if you elect to purchase any; (c) applicable sales use and other taxes; (d) loss of, or damage to the vehicle, which is included in the cost of repair of the retail value of the vehicle based on valuation methods accepted by the auto insurance industry on the date of the loss if the vehicle is not repairable, plus loss of use, diminution of the vehicle's value caused by damage to it or repair to it, and our administrative fees incurred for processing the claim; (e) all fines, penalties, forfeitures, court costs, towing charges and other expenses involving the Vehicle assessed against us or the Vehicle during your rental, unless these expenses are our fault; (f) all expenses we incur in locating and recovering the vehicle if you fail to return it or we elect to repossess the Vehicle under the terms of this agreement; (g) all costs, including pre and post judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this agreement; (h) a 2% late payment fee or the highest amount allowed by law, if lower , on all amounts past due; (i) One and one half percent per month interest, or the maximum amount allowed by the laws of the state where the vehicle is rented, for monies due but not paid upon return of the Vehicle; (j) Fifty dollars ($50.00) plus $5.00 per mile between the renting location and place where the vehicle is returned or abandoned, plus any additional recovery expenses we incur, and (k) Twenty Five dollars ($25.00) or the maximum amount permitted by law, whichever is greater if you pay us with a check backed by insufficient funds.

BREACH OF AGREEMENT. If you breach this agreement, you will be liable for all damage to, or loss of, the vehicle caused by your breach, unless otherwise provided by law.

MODIFICATIONS. No term of this agreement can be waived or modified except by a writing that we have signed. If you wish to extend the rental period, you must return the vehicle to our rental office for inspection and written amendment by us of the due date or time.

MISCELLANEOUS. No waiver by us of any breach of this agreement will constitute a waiver of any additional breach or waiver of the performance of your obligations under this agreement. Unless prohibited by law, you release us from any liability for consequential special or punitive damages in connection with this rental or the reservation of a vehicle. If any provision of this agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable. This agreement constitutes the entire agreement between you and us. All prior representations and agreements between you and us are merged into this agreement.

RENTAL AGREEMENT VIOLATIONS. You agree to properly operate this vehicle. If any of the following acts are committed, any coverage provided to you will be voided: (a) Operation of the vehicle by an unauthorized driver; (b) Violation of any provision of this Agreement while operating the vehicle; (c) Driving while intoxicated or under the influence of drugs, alcohol or other substances which would impair driving ability; (d) Reckless driving of the Vehicle to include, among other things, off regularly maintained roadways, to carry hazardous or explosive substances, to carry hazardous waste of any kind, to transport weight in excess of the vehicle's maximum payload capacity, where insufficient clearance or height or width exists, improper loading; (e) Transporting more passengers than number of seat belts or transporting passengers outside of the passenger compartment; (f) Using the Vehicle to participate or act or assist in any activity that violates any law, rule, or regulation; (g) Using vehicle to carry persons or property for hire; (h) Using Vehicle to engage in an organized or any other speed contest; (f) Using Vehicle to tow or push any other vehicle, trailer or other object; (j) Operation of Vehicle by person who has used false or misleading information to obtain the Vehicle; (k) Operating the Vehicle outside the continental United States and Canada; (l) Leave the vehicle and fail to remove the keys or close and lock all doors, windows, and the trunk and the vehicle is stolen.

RETURN OF THE VEHICLEYou must return the vehicle to our rental office or other location we specify on the date and time specified or earlier if demanded by the company, together with all tires, tools, accessories, and equipment and in the same condition that you received it, except for ordinary wear. Service to the vehicle or replacement of parts or accessories during the rental must have our prior approval. You will check and maintain all fluid levels including the brake fluid level in the master cylinder. In no event may the renter or any authorized driver keep the vehicle for more than thirty (30) days. In addition, failure to return the vehicle when due terminates permission for the renter and all authorized drivers to use the vehicle, and where permitted by law terminates any insurance coverage provided with the agreement. Advance may recover the vehicle without demand and at the renter’s expense, if it is not returned when due, is illegally parked, appears abandoned, or is used or obtained in violation of law or of this agreement. Advance will not be liable to the renter or any authorized driver for damages resulting from such recovery to the extent permitted by law. The renter waives any right to a hearing or to receive any notice or legal process as a pre-condition for the lessor recovering the vehicle.

ACCIDENT. In the event of a road traffic accident, if the renter is involved in a road traffic incident/accident, resulting in ANY damage to the rental car or third-party property, a police report must be obtained and produced to the rental company. Failure to report damage or produce such a report will void any CDW/LDW taken, resulting in the renter being liable for all costs involved in the rental car and third-party property. Renter shall immediately report ANY accident/damage to Advance and fill out an Incident/Claim Report. Renter must deliver to Advance or its insurer if so wanted by the rental company, every process, pleading, notice, or paper of any kind received by the renter or any driver of the vehicle relating to any claim, suit, or proceeding connected with any accident or event involving the Vehicle. Neither the Renter nor the driver of the vehicle shall aid or abet the assertion of any such claim, suit, or proceeding and shall cooperate fully with Advance and its insurer in investigating and defending the same.

Any use of the vehicle as prohibited below will (i) breach this Agreement; (ii) void any limitation of Renter’s responsibility for loss or damage to the Vehicle; (iii) make Renter fully responsible for Lessor’s actual and consequential damages, costs and attorney’s fees resulting from the breach and (iv) to the extent permitted by law, void any insurance protection provided under the Agreement. Subject to applicable law, the Renter, and renter’s authorized drivers may NOT permit the vehicle to be driven or operated:

a) by any person not specified in the agreement or anyone under the influence of intoxicants, alcohol, or drugs. b) in any speed contest or test or when overloaded or improperly loaded. c) without Lessor’s prior written permission outside of the State, off road, to tow or push anything, or for driver training purposes. d) to transport hazardous or explosive substances or the transportation of persons or property for compensation. e) in connection with conduct that is illegal. f) in a willful, wanton, or reckless manner, including but not limited to;

(i) failure to use seatbelt and required child restraints,

(ii) leaving the vehicle unattended without removing the keys and locking all doors, windows and trunk,

(iii) use of the vehicle, when used, will cause damage (i.e., warning light on, flat tire, steam arising from the engine). IN NO EVENT SHALL THE RENTER SUBRENT OR RE-LEASE THE VEHICLE TO ANOTHER PERSON OR CORPORATION. If the vehicle is obtained from the lessor by fraud or misrepresentation or is obtained or used in furtherance of an illegal purpose, all use of the vehicle is WITHOUT LESSOR’S PERMISSION. The foregoing conditions are cumulative and shall apply to the use, operation, or driving of the vehicle.

Loss or Damage to the Vehicle. You are responsible for all damage to or loss of the vehicle, loss of use of the vehicle while it is being repaired, diminution of the vehicle's value caused by damage to it or repair of it, missing equipment, and all administrative costs we incur due to damage to, or loss of, the vehicle regardless of whether or not you are at fault, unless this responsibility is otherwise limited by law. You must report all accidents or incidents of theft and vandalism to the police as soon as you discover them. You must report all accidents involving the vehicle to us immediately.

(a) Regardless of fault, the Renter is responsible for all loss of or damage to the Vehicle except for ordinary wear, accidental fire (not resulting from a collision, rollover, theft, or vandalism), or acts of nature beyond the Renter’s control.

(b) Your responsibility will not exceed the greater of: (i) the retail fair market value of the vehicle, or, (ii) the depreciated capitalized value as determined by the manufacturer at the time of loss or damage and under either alternative, less salvage value plus actual towing, storage or impound fees, and where permitted by law and administrative charge and a reasonable charge for loss of use.

(c) If the Renter purchases the Collision Damage Waiver (CDW) (which is not insurance) at the beginning of the rental and if the Vehicle is used as permitted by the Agreement, Advance will not hold the Renter responsible for loss or damage to the vehicle, including loss of use.

(d) ANY damage to the key will be the responsibility of the renter. Please note: A replacement key fee of $500 will apply to any damaged, broken, or lost keys. 

REPAIRS. The renter shall not permit any repairs to the vehicle or suffer any lien to be placed upon it without Advance consent. The renter shall be liable for any such repairs.

INDEMNITY. You agree to indemnify and hold Advance and its related companies and each of their respective directors, officers, employees, and agents harmless from and against any third-party claim or cause of action, including reasonable attorneys’ fees and costs, arising, directly or indirectly, in whole or in part, out of your access or use of the site or your violation of any law or the rights of any person.

VEHICLE USE DATA. Rental vehicles will contain hardware that gathers and transmits information about vehicle use. This is done as a security measure against accident or theft and also to provide you with valuable services and information.

LOCATION TRACKING. To prevent theft, and to allow us to locate you in case of emergency, accident, lock-out, etc., we track the location of your vehicle. Your location information will be confined to the company service, and we will never impermissibly make your location or movements public. As part of our service, the location of your vehicle may be released to insurance companies, the police, or similar parties in the course of an investigation and/or accident claim, and to assist in emergencies.

WEBSITE PROMOTIONS. Coupons/Codes: Advance provides specific discount coupons from time to time for the exclusive use of customers or members of specific entities with which Advance has a contractual relationship. These entity-specific coupons and the proprietary codes affixed on them are our proprietary property and may only be used by the determined customer or members of the specific entities for which the coupons apply. UNAUTHORIZED USE OR DUPLICATION OF ANY OF OUR ENTITY-SPECIFIC DISCOUNT COUPONS IS STRICTLY PROHIBITED.

Free Extra Driver: From time to time, we advertise a “Free Extra Driver” as part of a promotion. If you qualify for a free extra driver, this will be confirmed via email as well as saved in your booking record for our staff members to see on the day of your collection. If you arrive at the branch and there is no record of the Free Extra Driver offer, our rental staff will contact the Social Media Team to confirm eligibility.

Email Promotions: We may periodically send promotional emails about new cars, special offers, or other information that we think you may find interesting using the email address that you have provided. If you wish to remove an email address, please click the “Unsubscribe” link within the email footer.

Additional Information

Term changes: Advance provides this Website (Site) for your use, subject to these Terms of Use and all applicable laws and regulations. Advance reserves the right to revise these Terms of Use, so please check back periodically for changes.

Links to other sites: The site may include links to third-party Websites. Advance does not control and is not responsible for the content or privacy policies of any linked site, and the inclusion of any link on the site does not imply our endorsement of it.

Privacy Policy: Advance takes your privacy seriously. Any information submitted on or collected through the site is subject to our Privacy Policy. 

Advance reserves the right to cancel the delivery of the vehicle in case of doubts about the client's financial capacity, outstanding debts, or any serious incidents with Advance. For more inquiries, please contact us.
